In the heart of the 2024 campaign, the clarion call for protecting democracy resonates louder than ever. Two esteemed figures, Retired federal judge J. Michael Luttig and former Secretary of Homeland Security Jay Johnson, have sounded the alarm on the looming threat of authoritarianism. Their message is clear: the time to act is now.

Phil, thank you for your interest in the Democracy Summit here in Chicago. Judge Luttig, your decision to collaborate with a bipartisan group of lawyers is commendable. What threats do you perceive in today's political landscape?

American democracy and the rule of law are under siege. The American Bar Association and its 1.3 million members are rising to the occasion, answering the call to defend our nation's core values. American lawyers are uniquely positioned to support and defend our democracy, a responsibility they are embracing with fervor.

Our founding fathers feared a moment like this, where demagoguery might lead to the abandonment of democracy itself. The upcoming election in November is a litmus test for Americans' commitment to these principles.

Secretary Johnson, how does this threat undermine U.S. democracy?

The threats are multifaceted. Americans are losing faith in their democracy, and some political leaders are openly flirting with authoritarianism. The rhetoric has become overheated, irresponsible, and at times, it condones violence. The rise in political violence over the past few years is a stark reminder of the fragility of our democratic institutions.

You and Judge Luttig are leading a task force at the ABA convention in Chicago. How can lawyers contribute to safeguarding democracy?

Given their conflict resolution skills and legal background, lawyers are uniquely positioned to tamp down the rhetoric. They can volunteer to support election workers, become poll watchers, and educate community groups about election processes. Just as doctors stepped up during the Covid crisis, it's time for lawyers to defend the Constitution and the rule of law.

You both come from different political backgrounds. How can your message reach those with differing legal theories?

Our message is straightforward: American democracy and the rule of law are not political or partisan issues. These are the fundamental values upon which our nation was built. Politicians may politicize anything, but these principles remain beyond their reach. We urge all 1.3 million lawyers and the American public to join us in this stance.

Secretary, given the political violence we've witnessed, including the assassination attempt on the former president, what are your thoughts on this moment?

Despite our differing judicial and political philosophies, both Judge Luttig and I took an oath to support and defend the Constitution. The events of January 6th were a stark reminder of the need for a plain reading of the Constitution. Every responsible lawyer should come to the same conclusion, regardless of their political persuasion.

As we conclude, let us remember that the defense of democracy is not a partisan endeavor but a shared responsibility. The future of our nation depends on it.
